Not on the agenda, but discussed at the June 18 City Council meeting was the tabled appeal for Hilltop Liquor from Chuck Simmons. Simmons’ request for a conditional use permit was denied by the Planning Commission, but later deemed too close to a church (less than 1,000 feet) by an investigator for the state Alcohol Beverage Control board.

Council members discussed the appeal at the May meeting, but tabled it for one month.

At the meeting Tuesday, City Attorney Howard Slinkard advised the council members to vote on the tabled request even though it was a moot point as Simmons did not draw a permit during the June 12 draw from ABC.

“I think it’s a moot issue;

it’s still on the table. You probably ought to vote to either uphold or override the Planning Commission. you tabled it at the last meeting for tonight,” Slinkard told the Council. “I’d recommend you vote to uphold the Planning Commission.”

Mayor Jackie Crabtree was absent at both meetings,but had recommended upholding the Planning Commission.

“I make a motion that we uphold what the Planning Commission unanimously voted just to take this o◊the table,” council member Bob Cottingham said, but the motion died for lack of a second. Council member Nadine Telgemeier was absent.

In other business, the council:

◊Appointed Ken Hayes, director, and Jackie Crabtree, alternate, to the Benton/Washington Rural Water Authority Board.

◊Heard a report that the sidewalk project should begin soon and federal aid on the project is $55,000.
