Oaks pleads guilty

— BENTONVILLE - Kendall Wayne Oaks of Pea Ridge man avoided a jury trial by admitting he engaged in sexual contact with an intoxicated woman. He was charged with rape, a Class Y felony punishable with a prison sentence ranging from 10 to 40 years or life.

His jury trial was to begin last week, but Oaks agreed to plead guilty to a lesser charge. His plea was under an agreement attorney John Bassett reached with Deputy Prosecutor Nathan Smith.

Oaks, 31, pleaded guilty Tuesday, Nov. 16, to sexualassault in the second degree, a Class B felony.

Oaks was arrested Dec.

22, 2009. The woman was transported to Northwest Medical Center-Bentonville where a doctor determined her blood alcohol level was 0.33.

He had been in the county jail since his arrest last year.

Oaks also was ordered to pay $1,770 in court costs.

Oaks will be required to register as a sex offender and was ordered to enroll in the sex off ender treatment program at Ozark Guidance.

Green ordered Oaks not to have any type of contact or communication with the woman.
